House Bill 138 became effective September 11th, 2008.
EFFECTIVE DATE – House Bill 138 – The Lorain County Sheriff’s Office will process Order of Sales under House Bill 138 that have been filed with the Lorain County Clerk of Courts on or after September 11th, 2008. The projected date for our office to receive these filing is in January of 2009. Our 1st projected sale date under the new house bill will be sometime in March 2009.
ALL PURCHASERS WILL BE REQUIRED TO COMPLETE THE PURCHASE INFORMATION FORM ON SALES. This form is available under the forms section below or can be downloaded here. The purchaser information will also be available at the time of the sale.
The start date for purchase information forms shall be with the 1st sale date of 2009.
The completed purchaser information form shall be part of the sheriff’s return on the proceedings and shall be part of the record of the court of common pleas, this information is public record and open to public review.
ALL OTHER CHANGES RELATED TO HOUSE BILL 138 ARE EFFECTIVE ON OR ABOUT MARCH 2009. WE WILL POST NOTICE ON THE EXACT SALE DATE ONCE OUR OFFICE RECEIVES ORDER OF SALES THAT WERE FILED WITH THE CLERK’S OFFICE ON OR AFTER 09-11-2008. DEPOSITS – In every Sheriff’s Sale of real property, the purchaser shall be required to deposit 10% of the sale price or the amount listed in the deposit schedule. EXCEPTION FOR FIRST LIEN HOLDERS – If the successful bidder is also the 1st lien holder the deposit under this rule shall be waived, however all necessary payments for the following shall be paid within 14 days of the confirmation date. Each check shall be made out to the appropriate party. The Sheriff’s Civil office will record the deed within 14 days of receiving all of the necessary documents and fees.
